Abstract
Este trabajo analiza la importancia del diseño legal para transformar la producción legislativa del Congreso peruano, destacando su relación con derechos fundamentales como el acceso a la información pública y el acceso a la justicia. Parte del problema de la excesiva complejidad de los textos legales y su inaccesibilidad, que afecta el ejercicio de los derechos y la confianza ciudadana en las instituciones públicas. A través de la metodología Human-Centered Design (HCD), que sigue las fases de Escuchar, Crear y Entregar, se analizó como caso práctico la Ley de Modernización del Sistema Previsional Peruano (Ley N.º 32123). El prototipo resultante, denominado “Hazla Simple”, plantea nuevas formas de presentar las leyes mediante preguntas frecuentes, resúmenes y ejemplos prácticos, con el fin de reducir las barreras cognitivas y aumentar la autonomía de los ciudadanos en la toma de decisiones legales en su entorno. Los hallazgos revelan que rediseñar las leyes desde una perspectiva centrada en el ser humano no solo mejora su navegación y entendimiento, sino que también fortalece la relación sociedad-Estado. La investigación concluye que el diseño legal tiene un enorme potencial para modernizar el sistema legal peruano y garantizar mayor seguridad jurídica y acceso a la justicia. Propuestas como “Hazla Simple” no son un destino final, sino el inicio de un cambio necesario para acercar el Derecho a quienes más lo necesitan.
This study analyzes the importance of legal design in transforming the legislative production of peruvian Congress, highlighting its connection to fundamental rights such as access to public information and access to justice. It addresses the issue of the excessive complexity and inaccessibility of legal texts, which hinders the exercise of rights and undermines citizens’ trust in public institutions. Through the Human-Centered Design (HCD) methodology, which follows the phases of Listen, Create, and Deliver, the Law for the Modernization of the Peruvian Pension System (Law No. 32123) was selected as a case study. The resulting prototype, called “Hazla Simple” (Make it Simple), introduces new ways to present laws through frequently asked questions, summaries, and practical examples, aiming to reduce cognitive barriers and empower citizens to make informed legal decisions in their daily lives. The findings reveal that redesigning laws from a human-centered perspective not only improves their navigation and comprehension but also strengthens the relationship between society and the State. The research concludes that legal design holds significant potential to modernize the Peruvian legal system, ensuring greater legal certainty and access to justice. Proposals such as “Hazla Simple” are not an end point, but rather the beginning of a necessary shift to bring the law closer to those who need it most.
