Abstract
Se realizó un análisis sobre los posibles aportes de un marco “soft law” conocido como “Principios Voluntarios en Seguridad y Derechos Humanos” (PVSDH) al marco jurídico y regulatorio peruano aplicable a la gran y mediana minería. Estos principios fueron establecidos en el año 2000, resultado de un diálogo entre el gobierno de Estados Unidos, el Reino Unido, empresas extractivas transnacionales y ONGs, enfocado en abordar las problemáticas relacionadas con la seguridad y los derechos humanos. Se desarrollaron pautas preventivas dirigidas a las empresas, con el propósito de garantizar que tanto, la seguridad privada contratada para proteger sus instalaciones y personal, como la seguridad pública utilizada, actúen dentro del respeto a los derechos humanos. Para llevar a cabo esta investigación, se revisaron las siguientes fuentes: la normativa sectorial minera más relevante, regulación sobre las fuerzas de seguridad y los derechos humanos, la Constitución Política del Perú y estándares internacionales, incluyendo marcos vinculantes y voluntarios. También se analizó la implementación de los PVSDH en Colombia, así como los incentivos existentes tanto para las empresas como para el Estado en su adopción. El objetivo fue determinar si los PVSDH aportan al marco jurídico y regulatorio aplicable a la gran y mediana minería. Se concluyó que efectivamente aportan a este, complementando y reforzando la normativa existente de manera más articulada y colaborativa entre los diversos actores involucrados.
An analysis was conducted on the potential contributions of a "soft law" framework known as the "Voluntary Principles on Security and Human Rights" (VPSHR) to the Peruvian legal and regulatory framework applicable to large and medium-scale mining. These principles were established in 2000 as a result of a dialogue between the United States government, the United Kingdom government, transnational extractive companies, and NGOs, focused on addressing issues related to security and human rights. Preventive guidelines were developed for companies to ensure that both private security, contracted to protect their facilities and personnel, and the use of public security, act within the respect of human rights. To carry out this research, the following sources were reviewed: the most relevant Peruvian mining regulations, regulations on security forces and human rights, the Political Constitution of Peru, and international standards, including binding and voluntary frameworks. The implementation of the VPSHR in Colombia was also analyzed, as well as existing incentives for both companies and the state in their adoption. The objective was to determine whether the VPSHR contribute to the current national legal and regulatory applicable mining framework. It was concluded that they do indeed contribute to it, complementing and reinforcing existing regulations in a more articulated and collaborative manner among the various actors involved
