Revisión constitucional de la Ley n° 30407 – análisis jurisprudencial del estado regulatorio actual de las corridas de toros

Abstract

El presente trabajo de investigación se plantea a partir de un debate que ha trascendido del debate cultural, y ha generado discusiones desde la perspectiva jurídica: La constitucionalidad de las corridas de toros a la luz de la Ley N° 30407 de Protección y Bienestar Animal. El objetivo principal que se plantea el presente, es analizar si el estado regulatorio actual en relación a las corridas de toros, colisiona o no con otros derechos fundamentales. A través de un estudio dogmático – jurídico a partir de la jurisprudencia del Tribunal Constitucional y de la normativa vigente, se busca determinar si la regulación actual resulta acorde a un estado constitucional de las cosas. La relevancia de este estudio radica en la necesidad de realizar un ejercicio ponderativo entre la protección de los animales y el respeto a la diversidad cultural y las manifestaciones culturales.The present research paper is based on a debate that has transcended the cultural debate and has generated discussions from a legal perspective: The constitutionality of bullfighting in the light of Law No. 30407 of Animal Protection and Welfare. The main objective of this paper is to analyze whether or not the current regulatory status in relation to bullfighting collides with other fundamental rights. Through a dogmatic legal study based on the jurisprudence of the Constitutional Court and the regulations in force, the aim is to determine whether the current regulation is in accordance with a constitutional state of affairs. The relevance of this study lies in the need to carry out a weighing exercise between the protection of animals and respect for cultural diversity and cultural manifestations.
