La positivización constitucional de los neuroderechos en el ordenamiento jurídico peruano

Abstract

El avance de la neurotecnología, al intervenir directamente en la actividad cerebral, genera desafíos jurídicos que exigen una nueva respuesta normativa. En este contexto surgen los neuroderechos, una categoría emergente de cuarta generación orientada a resguardar la injerencia de la tecnología en la mente. Si bien su desarrollo aún es incipiente, con Chile como pionero en reconocerlos constitucionalmente, se propone su incorporación en el ordenamiento constitucional peruano para garantizar la autonomía personal frente al impacto de las tecnologías neurocognitivas.

Advances in neurotechnology, by directly intervening in brain activity, generate legal challenges that require a new regulatory response. In this context, neuro-rights have emerged, an emerging fourth-generation category aimed at protecting the mind from technological interference. Although their development is still in its infancy, with Chile as a pioneer in recognizing them constitutionally, their incorporation into the Peruvian constitutional order is proposed to guarantee personal autonomy in the face of the impact of neurocognitive technologies.
