Perú promotor de la minería ilegal

Abstract

La investigación tuvo como objetivo evaluar el impacto de la normativa que reguló el Registro Integral de Formalización Minera (REINFO) en la reducción de la minería ilegal en el Perú y analizar la viabilidad de un mecanismo jurídico alternativo desde el Derecho Administrativo Económico. Para ello, se empleó un enfoque cualitativo que combinó análisis normativo, revisión documental, evaluación ex post del funcionamiento del REINFO y entrevistas semiestructuradas a especialistas vinculados al ámbito minero y ambiental. Asimismo, se desarrolló una evaluación ex ante de una propuesta jurídica para abordar la problemática. Los resultados mostraron que el REINFO no logró reducir de manera significativa la minería ilegal. A pesar del elevado número de inscritos, la mayoría de registros permaneció suspendida y las formalizaciones concluidas representaron una fracción reducida del total. Las prórrogas sucesivas del régimen y la debilidad de los mecanismos de fiscalización favorecieron la continuidad de la informalidad bajo cobertura normativa. Se concluyó que el modelo de formalización vigente se encontraba agotado y que la incorporación constitucional de los principios de no regresión ambiental e in dubio pro natura constituía una alternativa jurídicamente viable para fortalecer la protección ambiental, contener retrocesos normativos y reordenar la política pública minera.

The objective of this research was to evaluate the impact of the regulatory framework governing the Comprehensive Mining Formalization Registry (REINFO) on the reduction of illegal mining in Peru and to analyze the feasibility of an alternative legal mechanism from the perspective of Economic Administrative Law. To this end, a qualitative approach was employed, combining normative analysis, documentary review, an ex post evaluation of REINFO’s performance, and semi-structured interviews with specialists in the mining and environmental fields. In addition, an ex ante evaluation of a legal proposal aimed at addressing the problem was conducted. The results showed that REINFO did not achieve a significant reduction in illegal mining. Despite the high number of registered operators, most registrations remained suspended, and completed formalizations represented only a small fraction of the total. Repeated extensions of the regime and weak enforcement mechanisms contributed to the persistence of informality under regulatory cover. It was concluded that the current formalization model had become exhausted and that the constitutional incorporation of the principles of environmental non-regression and in dubio pro natura constituted a legally viable alternative to strengthen environmental protection, prevent regulatory backsliding, and reorganize public mining policy.
