Abstract
La presente investigación se enfocó en establecer un análisis comparativo entre el modelo de la Ley vigente de Contrataciones del Estado y el modelo de contratos de Gobierno a Gobierno (G2G) bajo la modalidad de contratos NEC, considerando obras de gran envergadura del sector salud debido a su principal necesidad de parte de la población. El diseño de esta investigación tiene, para efectos de mayor sustento, comparar de forma cuantitativa los resultados obtenidos de los recursos empleados del tiempo de las obras construidas a partir de la modalidad de la Ley vigente de Contrataciones y de Obras construidas en base a la modalidad de Contratos Gobierno a Gobierno NEC. Así mismo, se empleó de forma cualitativa, la opinión de especialistas en el tema de construcción de proyectos, así como de proyectos de gran envergadura en construcción con el estado, bajo la modalidad de la Ley de Contrataciones, y de la mima forma con empresas extranjeras teniendo mayor conocimiento referente a los contratos NEC, obteniendo así la triangulación de los resultados obtenidos de cada entrevista con el fin de tener un consenso en base a la experiencia de profesionales en la materia. No se busca dejar de lado la Ley de Contrataciones ni menospreciarla, se identificaron aspectos para reforzar, lo que queremos es dar más opciones a propuestas de proyectos de gran envergadura utilizando la experiencia y conocimiento de expertos internacionales para obras que sean de necesidad primordial, en este caso se enfocó en incorporar aspectos y características de los contratos NEC a la Ley de Contrataciones, así como reforzar los aspectos de esta misma, con el objetivo de generar una vinculación y sinergia con la que se termina beneficiando la población.
The focus of this research was to establish a comparative analysis between Peru's current model of conventional contracts, executed under the framework of the State Procurement Law, and the Government-to-Government (G2G) contract model under the NEC contract modality, with an emphasis on large-scale healthcare projects due to their critical importance for the population. The research design involved a quantitative comparison of the results obtained regarding the resources utilized and the time employed in projects executed under the State Procurement Law versus those implemented through NEC-based G2G contracts. Additionally, a qualitative approach was employed, gathering insights from specialists in project construction and large-scale projects involving the State under the State Procurement Law, as well as from international companies with expertise in NEC contracts. Triangulation of interview results allowed for consensus based on the experience of professionals in the field. The aim of the research was not to disregard or undermine the State Procurement Law, which remains a foundational framework in the national context, despite identifying areas for improvement. Instead, the objective was to propose additional options for large-scale project execution by leveraging the experience and knowledge of international experts for essential infrastructure, particularly in the healthcare sector. The study focused on incorporating key aspects and characteristics of NEC contracts into the State Procurement Law, as well as reinforcing its existing provisions, with the ultimate goal of fostering synergy and integration that would concretely benefit the Peruvian population.
