En gustos y colores, no sólo deciden los proveedores: una mirada alternativa al caso de “La Rosa Náutica” ante el INDECOPI

Abstract

En el presente trabajo se analiza la Resolución N° 2758-2019/SPC (en adelante, la “Resolución INDECOPI”) que declaró fundada la denuncia de discriminación interpuesta contra el restaurante “La Rosa Náutica” (en adelante, “LRN”) por la entrega de Cartas-Menú de manera diferenciada a los hombres y mujeres que acudían a dicho establecimiento. Mediante la Resolución INDECOPI, se determinó que esta política comercial se basaba en una presunción generalizada de que las mujeres siempre serían las invitadas a una celebración y que nunca asumirían el costo del consumo. En consecuencia, se concluyó que no existía una causa objetiva y razonable que justificara este trato diferenciado. En ese contexto, este trabajo pretende discutir si, para el análisis de la conducta denunciada, resultaba necesario conocer si es que la política comercial en controversia se encontraba sustentada en los usos y costumbres del sector gastronómico en el que opera LRN y, de ser así, si es que dicha política podría ser tolerada y permitida por la normativa de protección al consumidor. Para tal efecto, se abordará el contenido del servicio de restauración y el rol que cumplen las preferencias y tradiciones de los consumidores que buscan acceder a este tipo de servicio. Ello, con la finalidad de determinar cómo estas realidades comerciales y sociales interactúan con el marco normativo establecido en la Ley N° 29571, Código de Defensa y Protección al Consumidor (en adelante, el “Código de Consumo”). Tras esta evaluación, se busca que el lector obtenga una visión más realista y completa del presente caso, permitiéndole reflexionar sobre cuál debería haber sido, en su opinión, la decisión final que correspondía adoptar en la vía administrativa.

This paper analyzes the Resolution No. 2758-2019/SPC (hereinafter, the “INDECOPI Resolution”) that declared founded the discrimination complaint filed against the restaurant “La Rosa Náutica” (hereinafter, “LRN”) for delivering differentiated Menu to men and women who attended the establishment. Through the INDECOPI Resolution, it was determined that this commercial policy was based on a generalized presumption that women would always be the guests at a celebration and would never bear the cost of consumption. Consequently, it was concluded that there was no objective and reasonable cause that justified this differentiated treatment. In this context, this paper aims to discuss whether, for the analysis of the reported conduct, it was necessary to know if the commercial policy in controversy was based on the uses and customs of the gastronomic sector in which LRN operates and, if so, whether that policy could be tolerated and allowed by consumer protection regulations. According to this analysis, the content of the catering service and the role played by the preferences and traditions of consumers seeking access to this type of service will be addressed. This is to determine how these commercial and social realities interact with the regulatory framework established in Law No. 29571, Consumer Defense and Protection Code (hereinafter, the “Consumer Code”). Following this assessment, the aim is for the reader to obtain a more realistic and complete view of the present case, allowing them to reflect on what, in their opinion, should have been the final decision to be adopted in the administrative proceedings.
