Abstract
El presente trabajo de investigación aborda un problema crítico que se presenta, principalmente, en los Contratos de Concesión del sector transporte en el Perú; el cual consiste en el incumplimiento o cumplimiento tardío en la entrega de terrenos por parte del Estado. Hemos identificado que dicho problema genera, en la mayoría de los casos, sobrecostos significativos en los esquemas de financiamiento, por lo que se hace necesario acudir a las renegociaciones contractuales para mitigar dichos efectos adversos. Con base en la literatura relevante y evidencia empírica, el trabajo tiene por propósito evaluar el impacto financiero de estos retrasos sobre la viabilidad de las concesiones y valorar la efectividad de las adendas como mecanismo de mitigación de los efectos generados por tales retrasos. Los hallazgos evidencian heterogeneidad y un patrón común: sin intervención, los retrasos erosionan valor; con intervención, el equilibrio puede restituirse. Por ello, como parte del análisis realizado se concluye que la suscripción de adendas destinadas a mitigar efectos negativos derivados del incumplimiento de las obligaciones del Estado, resulta ser eficaz para restablecer el equilibrio del contrato.
This investigation examines a critical bottleneck in Peru’s transport PPPs; which is related to the obligation from the State to deliver land for the execution of the project, such obligation is an exclusive obligation from the State. In this investigation it has been identified that such a problem, in most cases, is a generator of significant cost overruns in the financial schemes initially presented by private parties, therefore it’s necessary that, in turn, they promote the need to resort to contractual renegotiations to correct said adverse effects. Based on the relevant literature and empirical evidence, the purpose of the investigation is to evaluate the financial impact of these delays on the viability of the concessions and assess the effectiveness of the addenda as a mechanism to mitigate the effects generated by such delays. The findings show heterogeneity and a common pattern: without intervention, delays erode value; with intervention, balance can be restored. Therefore, as part of the analysis that has been carried out, it is concluded that the signing of addendums aimed at mitigating negative effects derived from non-compliance with the State’s obligations restored the balance of the Contract and, in turn, made it possible to solve the negative situation presented at the time of its signing.
