Abstract
Este trabajo analiza qué modificaciones normativas requiere el régimen peruano de fiscalización ambiental minera para regular adecuadamente el uso de sistemas de inteligencia artificial en los procesos de monitoreo ambiental del titular minero, partiendo de la premisa de que el principio de responsabilidad objetiva no se altera por la intervención de estas herramientas tecnológicas. Para ello, se desarrolla un análisis del marco normativo vigente (Ley N.º 28611, Ley N.º 29325, D.S. N.º 040-2014-EM, Ley N.º 31814, y Decreto Supremo N.º 115-2025-PCM), se examina la jurisprudencia del Tribunal de Fiscalización Ambiental del OEFA en casos emblemáticos donde intervinieron sistemas o hubo fallas de monitoreo, y se contrastan las obligaciones jurídicas que el Reglamento (UE) 2024/1689, la Directive on Automated Decision-Making de Canadá y el régimen de fiscalización de la Superintendencia del Medio Ambiente de Chile establecen para sistemas automatizados en sectores regulados, a partir de lo cual se formulan propuestas de modificación normativa fundamentadas en derecho comparado.
This paper examines what regulatory amendments Peru’s environmental mining oversight framework requires to adequately address the use of artificial intelligence systems in the environmental monitoring processes of mining concession holders, on the premise that the strict liability principle is not altered by the intervention of such technological tools. To that end, it develops an analysis of the current legal framework (Law N.° 28611, Law N.° 29325, Supreme Decree N.° 040-2014-EM, Law N.° 31814 and Supreme Decree N.° 115-2025-PCM), reviews the case law of the OEFA’s Environmental Enforcement Tribunal in landmark cases involving monitoring systems or monitoring failures, and contrasts the legal obligations established by the European AI Regulation (Regulation (EU) 2024/1689), Canada’s Directive on Automated Decision-Making, and the regulatory frameworks of Chile’s Superintendence of the Environment oversight regime, based on which it formulates proposals for regulatory reform grounded in comparative law.
