Después de la tormenta, llega la calma: la tercerización laboral después del Decreto Supremo 001-2022-TR

Abstract

En el presente artículo se analiza la controversia jurídica generada por el Decreto Supremo 001-2022-TR, que restringió la tercerización de actividades vinculadas al núcleo del negocio. Para ello, se examinan los cuestionamientos planteados ante el Tribunal Constitucional, INDECOPI y el Poder Judicial, así como los efectos de su nulidad declarada por la Corte Suprema mediante la Acción Popular 30989-2023-Lima y el régimen normativo actualmente vigente.

This article analyzes the legal controversy arising from Supreme Decree 001-2022-TR, which restricted the outsourcing of activities related to a company's core business. It examines the challenges raised before the Constitutional Court, INDECOPI, and the Judiciary, as well as the effects of its annulment by the Supreme Court through Popular Action Case 30989-2023-Lima, and the legal framework currently governing labor outsourcing in Peru.
