Informe jurídico sobre el expediente N° 005-1999/CLC: procedimiento administrativo sancionador seguido por Aero Continente S.A. contra el Banco de Crédito del Perú S.A.

Abstract

El presente informe analiza los principales problemas jurídicos del procedimiento administrativo sancionador iniciado por Aero Continente con el BCP ante INDECOPI por presunto abuso de posición de dominio, en la modalidad de negativa injustificada a contratar, debido a que el BCP se negó a abrir cuentas corrientes a Aero Continente entre setiembre y octubre de 1999. Para estos efectos, el informe analiza los argumentos expuestos por Aero Continente y el BCP, considerando el marco regulatorio aplicable en la época de los hechos, resoluciones administrativas y la doctrina académica en esta materia. Asimismo, se analizan los argumentos expuestos por la Comisión que declara infundada la denuncia interpuesta por Aero Continente en primera instancia; así como la decisión del Tribunal que la declara fundada en segunda instancia. Bajo dicho análisis, se concluye que el BCP no ostenta posición de dominio en el mercado relevante por lo que no ha incurrido en abuso de posición de dominio; y que aún en el supuesto negado que el BCP ostentará dicha posición, la negativa de abrir cuentas corrientes a Aero Continente se encontraba justificada por lo que no constituye abuso de dicha posición. Finalmente, el informe presenta algunas recomendaciones que debería considerar el INDECOPI al analizar los casos de abuso de posición de dominio en la modalidad de negativa injustificada de contratar.

This report analyzes the main legal issues of the administrative sanctioning procedure initiated by Aero Continente against BCP before INDECOPI for alleged abuse of dominant position, in the modality of unjustified refusal to contract, due to the fact that BCP refused to open checking accounts for Aero Continente between September and October 1999. For these purposes, the report analyzes the arguments presented by Aero Continente and BCP, considering the regulatory framework applicable at the time of the facts, administrative resolutions and academic doctrine on this matter. Likewise, it analyzes the arguments presented by the Commission that declares the complaint filed by Aero Continente unfounded in the first instance; as well as the decision of the Court that declares it founded in the second instance. Under this analysis, it is concluded that BCP does not hold a dominant position in the relevant market and therefore has not incurred in abuse of dominance; and that even if BCP did not hold such position, the refusal to open checking accounts to Aero Continente was justified and therefore does not constitute abuse of such position. Finally, the report presents some recommendations that INDECOPI should consider when analyzing cases of abuse of dominance in the modality of unjustified refusal to contract.
