Informe del expediente: RES. 2182-2018-SUNARP-TR-L formalización de un contrato de compraventa de un terreno donde se señale que la edificación existente no es propiedad del vendedor

Abstract

La razón del presente trabajo es realizar un análisis jurídico de la institución de la compraventa desde su nacimiento en la esfera civil regulada por el Código Civil del Perú y su efecto en el derecho registral, puesto que para acceder a la inscripción registral de un acto jurídico como en este caso la compraventa, debe ceñirse a una serie de requisitos y evaluaciones de carácter registral que presentaré en el presente informe: aplicación del reglamento de inscripciones del registro de predios y su concordancia con el Código Civil. Así como también justifica la presente investigación la posición del Tribunal Registral de la Superintendencia Nacional de los Registros Públicos, órgano colegiado quien resuelve el caso y establece una serie de parámetros entre la calificación civil del contrato de compraventa con la calificación registral que recae en el levantamiento de observaciones registrales para que el contrato de compraventa proceda a inscribirse en el Registro Público.

The reason for this work is to carry out a legal analysis of the institution of sale from its birth in the civil sphere regulated by the Civil Code of Peru and its counterpart with the registration right, since to access the registration of a legal act.
